How to Get a Carter County Marriage License

Both people must come to the courthouse together. You cannot send one person alone. Bring valid ID such as a driver's license, birth certificate, passport, or conceal carry license. If you have a foreign ID, you also need a translated birth certificate. The clerk will check your documents and have you fill out the application. Both applicants sign and swear to the information on the form.

Adults 18 and older get the license the same day with no wait. If either applicant is 16 or 17, a parent must be present and give consent. A 72-hour waiting period applies for minors. No one under 16 can apply except by court order. There is no blood test and no requirement that you live in Carter County. Anyone can apply here regardless of where they live.

The marriage license stays valid for 10 days once issued. Hold the ceremony within that time. After the wedding, the person who performed it and two witnesses aged 18 or older sign the license. Then it must be sent back to the Carter County Court Clerk within 30 days. Be aware that court judges in Carter County do NOT perform courthouse marriages. You will need to find a minister or other qualified officiant on your own.

Carter County Marriage License Requirements

Oklahoma law sets the same rules statewide. Here is what the Carter County Court Clerk needs from you:

  • Valid ID for both applicants (driver's license, birth certificate, passport, or conceal carry license)
  • Foreign IDs need a translated birth certificate
  • Both must be 18 or older (or 16-17 with parental consent)
  • Two witnesses aged 18+ for the ceremony
  • No blood test and no residency rule

If either person was divorced in Oklahoma, a six-month waiting period applies before remarrying someone new. This rule is in Title 43 of the Oklahoma Statutes. The restriction does not apply if you are getting back together with your former spouse. Chickasaw Nation marriage records are also available in Carter County for the pre-statehood period, since the county was formed from Chickasaw Lands in 1907.

Fees for Carter County Marriage License
