Jefferson County is one of the smaller counties in Oklahoma. The courthouse sees less traffic than urban counties, so wait times are usually short. If you are driving from out of town, call ahead to make sure the office is open that day. Holiday closures and occasional early closings can happen with little notice in smaller counties.

The clerk can also tell you over the phone whether a specific marriage license record is on file. They can pull older records from the archives and make copies while you wait. Mail requests are accepted too. Send your request with the names, approximate date of the marriage, and a check or money order for the copy fee.

Apply for a Jefferson County Marriage License

Both people must go to the Jefferson County Court Clerk's office in person at the same time. No exceptions. You each need a valid photo ID. A driver's license, passport, state ID, or military ID all work. The clerk checks your identity and age before letting you fill out the application form.

The application asks for both names, dates of birth, Social Security numbers, and information about any past marriages. If you were married before, you need to say how that marriage ended. Under Oklahoma Statutes Title 43, a divorced person must wait six months before getting a new marriage license unless they are remarrying the same former spouse. The clerk may ask for proof of the divorce if the date is recent.

Once you complete the form and pay the fee, the clerk issues the marriage license right away for applicants 18 and older. There is no waiting period. The license is valid for 10 days. Hold your ceremony within that time. After the wedding, the person who performed the ceremony and two witnesses aged 18 or older sign the license. You then return the signed license to the Jefferson County Court Clerk. The law gives you up to 30 days to return it, but sooner is better.

Oklahoma sets the legal age to marry at 18. Applicants aged 16 or 17 must have a parent or legal guardian present to give written consent. A 72-hour waiting period applies for minors. No one under 16 can get a marriage license in Jefferson County unless a judge specifically authorizes it under court order.

There is no blood test. Oklahoma dropped that rule back in 2005. There is also no residency requirement for a Jefferson County marriage license. You do not have to live in the county or in the state. Out-of-state couples can walk in, apply, and get their license the same day. The license works anywhere in Oklahoma, so you can have your ceremony in any county.
