The County Clerk's office for land records is in a separate building at 315 West 6th Avenue, Suite 202. You can reach that office at (405) 747-8310. If you need both land records and a marriage license, plan for two stops.

Payne County was one of the original counties created in 1890, named for David L. Payne who led the Boomer movement. The courthouse stores marriage records from 1894, probate records from the same year, and land records going back to 1884. Court files are kept at the courthouse for easy access, though some older criminal records are stored at a separate location.

How to Get a Marriage License in Payne County

Both people need to come to the courthouse at the same time. Bring valid photo ID. A driver's license is the most common choice, but passports, state IDs, and military IDs all work. The clerk will ask for your full name, date of birth, Social Security number, and the name you plan to use after the wedding. If either person was married before, bring details about how that marriage ended.

Fill out the application and pay the $50 fee. The clerk issues the license on the spot. No waiting period applies for adults 18 and older under Oklahoma Statutes Title 43. You could have your ceremony the same day. The license is valid for 10 days, so make sure your wedding happens within that window. Two witnesses are required at the ceremony. After the wedding, the officiant completes the license form and returns it to the Payne County Court Clerk.

Note: Payne County requires two witnesses at the ceremony in addition to the officiant who signs the marriage license.

Courthouse Wedding Ceremonies in Payne County

Payne County is one of the Oklahoma counties where judges will perform wedding ceremonies. Judges Kistler, Thomas, and Hert have all been known to officiate marriages at the courthouse. This is a big plus if you want a simple, no-fuss ceremony right after you get your license. Not every county offers this. In fact, many Oklahoma counties (including Oklahoma County) do not have judges who perform daily ceremonies.

If you want a judge to marry you at the Payne County courthouse, call the clerk's office at (405) 372-4774 to check availability. Judges have their own schedules and may not be free every day. Plan ahead. You still need to bring your own witnesses. The ceremony itself is quick but still legally binding and official.

The rules are set by the state and are the same everywhere in Oklahoma. You must be 18 to apply on your own. Applicants aged 16 or 17 need a parent or legal guardian present. That parent must bring valid photo ID and the minor needs a certified birth certificate with a raised seal. A 72-hour wait applies when either person is under 18. Court approval is needed for anyone under 16.

No blood test is required. Oklahoma got rid of that years ago. There is no residency rule either. You can live in Stillwater, in another state, or even in another country and still apply at the Payne County courthouse. The license works for a ceremony anywhere in Oklahoma. What to bring:

  • Valid photo ID for both people
  • Social Security numbers
  • Certified birth certificate if under 18
  • Divorce decree date if previously married
  • Death certificate of prior spouse if applicable
  • Parental consent and guardian photo ID for minors

If your last marriage ended in divorce, you need to wait six months before you can marry someone new. Oklahoma law makes an exception if you are remarrying the same person.

Marriage License Fees in Payne County

The standard fee is $50. Same as every other county in the state. Bring a premarital counseling certificate and the fee drops to $5. Both people must complete at least four hours of counseling. The certificate must be the original. No copies or faxes. The provider must meet the qualifications listed in 43 O.S. Section 5.1.
