How to Apply for a Stillwater Marriage License

Walk into Room 207 with your partner. Both people must be there. Bring a valid photo ID. The clerk accepts a certified birth certificate, driver's license, passport, or visa as ID. The application process takes about 30 minutes. The clerk will ask for your full legal names, dates of birth, Social Security numbers, and the names you will use after the wedding.

If you were married before, you need proof of how that ended. A divorce decree or death certificate works. Oklahoma law under Title 43 of the Oklahoma Statutes requires a six-month wait after a divorce before you can marry someone new. The exception is if you are remarrying your former spouse. Once the form is complete and you pay the fee, the license is issued on the spot. Adults 18 and older face no waiting period.

The license is valid for 10 days. The day you get it counts as day one. Have your ceremony before it expires. After the wedding, the officiant completes the rest of the form. Return it to the Payne County Court Clerk within 5 days of the ceremony. Both parties sign with the names they plan to use going forward.

Note: The Payne County Court Clerk office also offers passport services, so you can handle multiple tasks in one visit to the courthouse.

State rules apply across all 77 Oklahoma counties. You must be 18 to apply without consent. If you are 16 or 17, a parent or legal guardian must come along and sign a consent form. There is a 72-hour waiting period for minors. No one under 16 can marry without a court order. No blood test is needed. Oklahoma dropped that in 2005.

There is no residency rule. You do not have to live in Stillwater, Payne County, or Oklahoma. People from other states apply here too. The process works the same for everyone. If you hold a foreign ID, bring a translated birth certificate along with it. Payment is flexible at this office. They take cash, checks, money orders, bank debit cards, Visa, American Express, and MasterCard.

  • Valid photo ID (certified birth certificate, driver's license, passport, or visa)
  • Social Security number for both applicants
  • Divorce decree or death certificate if previously married
  • Parental consent and certified birth certificate for ages 16-17
  • Translated birth certificate if using foreign ID

Marriage License Fees in Stillwater

The fee is $50. Payne County accepts a wide range of payment types. Cash, checks, money orders, bank debit cards, Visa, American Express, and MasterCard all work. That gives you more options than many other counties in the state. If a judge performs your ceremony, there is an extra $10 charge on top of the license fee.

You can reduce the license fee to $5 with a premarital counseling certificate. It must be the original paper document. No copies. No faxes. Both parties must have completed at least four hours of counseling with a qualified provider per 43 O.S. Section 5.1. Licensed mental health professionals, clergy members, and people trained in nationally recognized programs like PREP all qualify. That saves you $45.

Need copies of a marriage license already on file? In-person copies are usually available right away. Mail requests take one to two weeks to process. The first page costs $1.00 and each additional page is $0.50. A certified stamp adds $0.50 to the total.

Courthouse Weddings in Stillwater

Stillwater is one of the few places in Oklahoma where judges still perform wedding ceremonies. Three judges are available by appointment. Judge Kistler can be reached at (405) 372-3999. Judge Thomas is at (405) 372-4380. Judge Hert is at (405) 747-8383. Call one of them to schedule your ceremony. You must set up the appointment. Same-day ceremonies are possible if a judge has an open slot, but call first.

There is an extra $10 fee when a judge performs the ceremony. Two witnesses at least 18 years old must be present. If you do not use a judge, any ordained minister, priest, rabbi, or person authorized under Oklahoma law can officiate. As of November 1, 2022, ministers no longer need to file their credentials with the Court Clerk per O.S. Title 43, Section 7.

After the ceremony, the officiant and both witnesses sign the license. The form goes back to the Payne County Court Clerk. The preferred return time is within 5 days.
