Applying for a Marriage License in Pontotoc County

Both people must come to the Pontotoc County Court Clerk's office together. You can not have one person apply alone. Each person needs a valid photo ID. A driver's license is the most common form of ID people bring. A passport or state ID works too. Military ID is also fine. If your ID is from another country, bring a translated birth certificate along with it.

The application asks for your full legal names, dates of birth, and the names you plan to use after the marriage. If either person was married before, the clerk needs to know when and how that marriage ended. Bring the date of any prior divorce. Once you fill out the form and pay the $50 fee, the Pontotoc County clerk issues the license on the spot. There is no waiting period for adults age 18 and older under Oklahoma Statutes Title 43.

The license is good for 10 days. Hold your ceremony within that time frame or the license expires and you have to start over. After the wedding, the officiant and two witnesses sign the license. The signed document goes back to the Pontotoc County Court Clerk within 30 days so it can be filed as a permanent public record.

Note: Pontotoc County marriage license applications need both parties present at the clerk's office in Ada with valid photo ID.

The state of Oklahoma sets the rules. You must be 18 to apply on your own. If you are 16 or 17, a parent or guardian must appear with you and give written consent. Minors also have a 72-hour waiting period. No one under 16 can get a license except through a court order.

Oklahoma does not require a blood test. That rule ended in 2005. There is no residency requirement either. You can live in Ada, Dallas, or anywhere else and still get your marriage license at the Pontotoc County courthouse. The license is valid for use at any ceremony location in Oklahoma. Below is a list of what to bring with you:

  • Driver's license or state photo ID
  • Passport or certified birth certificate
  • Military ID if applicable
  • Social Security number
  • Date of any prior divorce decree
  • Death certificate of former spouse if widowed

Under Title 43, Section 128 of the Oklahoma Statutes, anyone divorced in Oklahoma must wait six months before remarrying someone new. The wait does not apply when remarrying the same former spouse.
