How to Get a Marriage License in Okfuskee County

Both people who want to get married must show up at the Okfuskee County Court Clerk's office at the same time. You cannot send just one person or have a friend apply for you. Each person needs a valid form of photo ID. A driver's license works. So does a passport, state ID card, or military ID. If you have a foreign ID, bring a translated birth certificate too. The clerk will ask you to fill out an application form with your full name, date of birth, Social Security number, and the name you plan to use after the wedding.

If either person was married before, you must share the date and type of how that marriage ended. Once the form is done and you pay the $50 fee, the clerk issues the license right there. Adults 18 and older have no wait at all under Oklahoma Statutes Title 43. You could hold your ceremony that same day. The license stays good for 10 days. Your wedding must happen in Oklahoma within that period.

After the wedding, the officiant and two witnesses sign the license. It then goes back to the Okfuskee County Court Clerk within 30 days so it can be filed as a permanent record. The officiant can be a judge, retired judge, or ordained minister. Since November 2022, ministers no longer file credentials with the Court Clerk under O.S. Title 43, Section 7.

Note: Two competent adult witnesses are required at every marriage ceremony in Okfuskee County and across all of Oklahoma.

Oklahoma law applies the same rules in all 77 counties. There is no blood test for a marriage license. That rule was eliminated in 2005. There is no residency requirement. You could live in any state and still apply at the Okfuskee County courthouse in Okemah. The license can be used for a ceremony anywhere in Oklahoma.

Age is a key factor. You must be 18 to apply on your own. Applicants who are 16 or 17 need a parent or legal guardian present to give written consent. A 72-hour waiting period also applies to anyone under 18. No one under the age of 16 can get a marriage license without a court order. If you were divorced in Oklahoma, state law requires a six-month wait before you can marry someone new, unless you are remarrying the same person. Here is what you should bring to the Okfuskee County courthouse:

  • Valid driver's license or state photo ID
  • Passport or certified birth certificate with raised seal
  • Military ID if you serve
  • Social Security number
  • Date of divorce decree if previously married

These are the basic items the clerk needs to process the application. If your situation is more complex, call (918) 623-0525 ahead of time so the staff can tell you if you need anything else.

Okfuskee County Marriage License Fees

A standard marriage license costs $50 in Okfuskee County. This is the same price across every county in Oklahoma. The certificate has to be the original. Copies and faxes do not count.

Copies of old marriage records are low cost. The first page is $1. Each extra page is 50 cents. A certified copy costs about $1.50 with the certification stamp.
