Applying for a Pushmataha County Marriage License

Both people must appear at the Pushmataha County Court Clerk's office at the same time. One person can not apply on behalf of the other. Each of you needs valid photo ID. A driver's license, passport, state ID, or military ID will work. If you have an ID from another country, bring a translated birth certificate too.

The clerk has you fill out an application form. It asks for both full legal names, dates of birth, Social Security numbers, and the names you want to use after the wedding. If either person has been married before, the clerk will ask about how that marriage ended and the date it was finalized. Once the form is done and you pay the $50 fee, the clerk hands over the Pushmataha County marriage license on the spot. Under Oklahoma Statutes Title 43, there is no waiting period for adults who are 18 or older. You could hold the ceremony the same day.

The license is good for 10 days. Get married within that window or you have to start over. After the ceremony, the officiant and two witnesses sign the license. Then the signed document must go back to the Pushmataha County Court Clerk within 30 days.

Note: Pushmataha County marriage license applications require both parties in person with valid ID and the $50 fee at the courthouse in Antlers.

Oklahoma law sets the rules for all 77 counties. You have to be 18 years old to apply on your own. If you are 16 or 17, you need a parent or legal guardian to come to the Pushmataha County courthouse with you and sign a consent form. Minors also have a 72-hour waiting period. Nobody under 16 can get a marriage license unless a judge specifically orders it.

No blood test is needed. Oklahoma ended that rule in 2005. There is no residency requirement either. You can live anywhere in the country or the world and still apply for a marriage license at the Pushmataha County courthouse. The license works for ceremonies held anywhere in the state of Oklahoma. Bring the following items with you:

  • Valid driver's license or state-issued photo ID
  • Passport or certified birth certificate
  • Military ID if applicable
  • Social Security number
  • Divorce decree date if previously married
  • Death certificate of former spouse if widowed

If you got divorced in Oklahoma, Title 43, Section 128 says you must wait six months before marrying someone new. Remarrying the same former spouse is the only exception to this rule.
