How to Get a Choctaw County Marriage License

Both parties must appear in person before the clerk. You fill out a written application and both applicants sign it under oath. The clerk needs to see valid ID showing your full legal name and age. A birth certificate, driver's license, or passport all work. You must also provide your full name as you want it to appear after the marriage.

If both people are 18 or older, there is no wait. The license is issued the same day. For applicants aged 16 or 17, a parent or legal guardian must come along to give consent. The application sits on file for at least 72 hours before the clerk can hand over the license. No blood test is required. There is no rule that says you must live in Choctaw County or even in Oklahoma.

The license is good for 10 days after it is issued. After the ceremony, the officiant and two adult witnesses sign the document. It must be returned to the Choctaw County Court Clerk within 30 days. Under Title 43, Section 7 of Oklahoma law, ordained ministers, judges, and retired judges are authorized to perform marriages. Ministers have not been required to file their credentials with the Court Clerk since November 2022.

Choctaw County Marriage License Requirements

Oklahoma uses the same rules across all 77 counties. Here is what you need for a Choctaw County marriage license:

  • Both applicants in person with valid ID (birth certificate, driver's license, passport)
  • Full legal name and age shown on ID
  • Must provide the name to be known as after marriage
  • Ages 18+ need no parental consent
  • Ages 16-17 require parental consent and a 72-hour wait
  • No blood test and no residency rule

If either applicant was divorced in Oklahoma, they must wait six months before they can marry someone new. This is under Title 43 of the Oklahoma Statutes. That rule does not apply if you are remarrying your former spouse.

Choctaw County Marriage License Fees

The fee is $50. That is the standard across Oklahoma. If you complete premarital counseling under Oklahoma Statute 43 O.S. 5.1, the fee drops to $5. The original certificate is required. Copies and faxes will not work for the discount.

Record copies cost $1.00 for the first page and $0.50 per additional page. These fees apply whether you pick up copies in person or have them mailed to you.

Note: The Choctaw Nation also issues its own marriage licenses for tribal members, which is a separate process from the county.
