How to Apply for an Ellis County Marriage License
Both people go to the courthouse together. That is the first rule. You cannot send someone else or apply alone. Walk into the Court Clerk's office at 100 S. Washington Street during business hours. Fill out the application. Show valid photo ID. Pay the fee. If both applicants are 18 or older, the clerk issues the license right then.
Bring a driver's license, passport, state photo ID, military ID, or certified birth certificate with a raised seal. Oklahoma has not required a blood test since 2005. There is no residency requirement. You can live in Texas, Kansas, or anywhere and still get a marriage license in Ellis County. The license works in every Oklahoma county under Oklahoma Statutes Title 43.
Once you have the license, it is good for 10 days. Hold your ceremony during that window. An ordained minister, judge, or retired judge can officiate under Title 43, Section 7. Ministers no longer need to file their credentials with the clerk as of November 2022. Two adult witnesses must be present at the ceremony. After the wedding, return the signed license to the Ellis County Court Clerk. The law says to do this within 30 days, though sooner is always better.
Note: Ellis County has no known courthouse disasters, so marriage records going back to 1892 remain intact and available for research.
Ellis County Marriage License Requirements
The requirements are set by state law. Both people must be present. Valid photo ID is required. Adults 18 and older face no waiting period at all. No blood test. No residency rule. It is a simple process in a small county.
For applicants who are 16 or 17, things get more complicated. One parent or legal guardian must appear at the clerk's office to give written consent. After the application is filed, there is a 72-hour waiting period before the license is issued. Nobody under 16 can get a marriage license in Oklahoma unless a court specifically orders it. This comes from Title 43 of the Oklahoma Statutes and applies the same way in all 77 counties. The Ellis County Court Clerk follows these rules to the letter.
If either applicant was divorced in Oklahoma, the law requires a six-month wait before marrying someone new. The sole exception is if you are remarrying the same person you divorced. The clerk will ask about previous marriages during the application process. Two witnesses who are at least 18 years old must attend the wedding ceremony. Both witnesses sign the marriage license along with the officiant.
Ellis County Marriage License Fees
The standard marriage license fee in Ellis County is $50, the same as every other county in Oklahoma. You can get the reduced rate of $5 by presenting an original premarital counseling certificate. Both applicants must have completed at least four hours of counseling. The counselor needs to be a licensed mental health professional, a religious institution representative, or someone trained in a nationally recognized program like PREP. Under Oklahoma Statutes Title 43, Section 5.1, only the original certificate is accepted.
Copies of existing marriage records cost around $1.00 for the first page and $0.50 for each page after that. Certified copies add a $0.50 certification fee. A record search may cost $5 to $10. Cash is king at small county courthouses like Ellis, but money orders are accepted for mail requests.
