Delaware County Court Clerk Office

The Delaware County Court Clerk issues all marriage licenses for the county. The office is located at the Delaware County Courthouse, 327 S. 5th Street, in Jay. Jay is a small town, and the courthouse is easy to find right in the center of things.

If you want to request records by mail, send your letter to P.O. Box 407, Jay, OK 74346. Include both parties' names, the approximate marriage date, and a money order or check for the copy fee. These are two different offices with different functions, so make sure you ask for the Court Clerk when you need a marriage license.

Both people must go to the Court Clerk's office together. This is a state requirement and there are no exceptions. Bring valid photo ID such as a driver's license, passport, state ID, or military ID. A certified birth certificate with a raised seal works too. No blood test is needed in Oklahoma. That was dropped in 2005.

If both applicants are 18 or older, the clerk issues the marriage license right away. No waiting. You fill out the application, pay $50, and walk out with the license in hand. The whole thing takes a few minutes in a county the size of Delaware. No appointment is needed during regular hours.

After you get the license, you have 10 days to hold the ceremony. Find an officiant, which can be a judge, retired judge, or ordained minister under Oklahoma Statutes Title 43, Section 7. Have two adult witnesses present. Once the ceremony is done, the officiant and witnesses sign the license. Return the signed license to the Delaware County Court Clerk. You should do this within 5 days, though the law gives you up to 30.

Ministers no longer need to register their credentials with the Court Clerk before performing a marriage in Oklahoma. That rule changed on November 1, 2022.

Delaware County Marriage License Requirements

Oklahoma keeps the rules simple. Both applicants need valid photo ID. Must be at least 18 to apply without parental consent. No blood test. No residency requirement. You do not need to live in Delaware County or even in Oklahoma.

For applicants aged 16 or 17, a parent or legal guardian must come to the clerk's office and sign a consent form. There is a 72-hour waiting period between the application and when the license is actually issued. Under Oklahoma law, nobody younger than 16 can get a marriage license without a court order and a physician's letter. These age rules apply in every Oklahoma county the same way.

The six-month divorce rule also applies here. If you got divorced in Oklahoma, you cannot marry someone new for six months after the decree was filed. The exception is remarrying your former spouse. This is part of Title 43 of the Oklahoma Statutes. The Delaware County Court Clerk will check for previous marriages as part of the application process.

Note: Delaware County probate records go back to 1867 and court records to 1868, but marriage records specifically start from 1911.

The fee is $50 for a standard marriage license. Every county in Oklahoma charges this same amount. Bring an original premarital counseling certificate and the fee drops to $5. The certificate needs to show that both parties did at least four hours of counseling with a qualified provider. Under Oklahoma Statutes Title 43, Section 5.1, that provider must be a licensed mental health professional, a religious institution representative, or someone trained in a nationally recognized curriculum like PREP.

Only the original certificate is accepted. Copies, faxes, and emails will be turned away. The counseling must cover both people, and the certificate must list both names.

For copies of existing marriage records, expect to pay around $1.00 for the first page and $0.50 for additional pages. A certification fee of about $0.50 applies if you need a certified copy. Record search fees range from $5 to $10 in most Oklahoma counties. Delaware County tends to accept cash for in-person visits and money orders for mail requests.
