How to Apply for a Cherokee County Marriage License
Both people planning to marry must go to the Court Clerk's office together. You fill out the application in person and sign it. Each applicant needs a valid form of ID. The clerk accepts a driver's license, birth certificate, passport, or military ID. If both applicants are 18 or older, there is no waiting period. You get the license that same day.
Minors aged 16 or 17 need a parent or legal guardian present to consent. They must also bring a certified birth certificate as proof of age. Oklahoma law requires a 72-hour waiting period for applicants under 18. The application goes on file and the license is issued after three days. No one under 16 can get married in Oklahoma except by court order. There is no blood test requirement. That rule was eliminated statewide in 2005.
After the license is issued, it is good for 10 days. The ceremony must happen within that window. Two witnesses aged 18 or older must attend and sign the license along with the officiant. Under Oklahoma Statutes Title 43, Section 7, ministers, judges, and retired judges can perform the ceremony. The signed license needs to go back to the Cherokee County Court Clerk within 30 days.
There is no residency rule. You do not have to live in Cherokee County or in Oklahoma to apply here.

Cherokee Nation and Marriage Records
Cherokee County is unique because Tahlequah is the capital of the Cherokee Nation. The Cherokee Nation operates its own court system for tribal members. If you are a member of the Cherokee Nation, you may have additional options for marriage-related services through the tribal courts. The county Court Clerk handles state-issued marriage licenses regardless of tribal membership. For tribal court matters, contact the Cherokee Nation directly. Northeastern Oklahoma State University is also located in Tahlequah, which means the courthouse sees a steady stream of younger applicants during the school year.
